1. Acceptance of Terms

By accessing and using mojo ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms, please do not use the Service.

2. Service Description and AI Technology Disclosure

mojo is a health data tracking and analysis application designed specifically for users of GLP-1 weight loss medications (such as Mounjaro, Saxenda, etc.). The Service uses artificial intelligence (AI) technology to analyze your health data, including weight, body fat percentage, muscle mass, medication usage records, side effects, diet, exercise, and sleep information, and generates personalized reports and recommendations. AI Technology Limitations: AI analysis is based on algorithms and statistical models, which may contain errors, inaccuracies, or incompleteness. AI-generated content should not be used as the sole basis for medical decisions.

3. Medical Disclaimer

IMPORTANT: The Service does not provide medical advice, diagnosis, or treatment. All AI-generated reports, recommendations, analyses, and feedback are for informational purposes only and cannot replace professional medical advice from qualified healthcare providers. GLP-1 Medication Warning: mojo provides tracking features for GLP-1 weight loss medications (such as Mounjaro, Saxenda, Ozempic, Wegovy, etc.), but does not provide prescriptions, dosage recommendations, medication plan adjustments, or any form of medical supervision. All medication use must be under the guidance of a qualified physician. Before making any health-related decisions (including but not limited to: adjusting medication dosage, starting or stopping medications, changing diet or exercise plans), you must consult qualified healthcare professionals. We do not guarantee any weight loss results, and results vary by individual. Emergency Situations: If you experience severe side effects or health emergencies, seek immediate medical attention or call emergency services. Do not rely on this Service for emergencies.

4. User Eligibility and Age Restrictions

The Service is only available to users aged 18 years or older. If you are under 18 years old, please do not use the Service. Before using the Service, you should ensure that you are legally eligible to use GLP-1 medications and have obtained a prescription from a physician. If you have any of the following conditions, please consult a physician before using the Service:

• Pregnant or breastfeeding
• Suffering from severe cardiovascular disease, kidney disease, or liver disease
• History of medullary thyroid carcinoma or multiple endocrine neoplasia
• Currently taking other prescription medications

You represent and warrant that all health information you provide is truthful, accurate, and complete.

5. User Responsibilities

As a user of the Service, you agree to:

• Truthful Recording: Accurately record your health data, including weight, medication usage, side effects, and other information.
• Personal Responsibility: You are solely responsible for any health decisions you make based on information provided by the Service. You use the Service at your own risk.
• Legal Compliance: Use the Service only for lawful purposes and not in any way that violates applicable laws and regulations.
• Account Security: Safeguard your account information and do not share it with others.
• Prohibition of Abuse: Do not abuse the Service, including but not limited to: uploading false information, distributing malware, or infringing on others' rights.

6. Device Security Responsibility

You are responsible for maintaining the security of your device and access to the Service. Please note:

• Device Security: Do not jailbreak or root your device, or make any unauthorized modifications to your device's operating system. Such modifications may compromise the security of the Service and put your health data at risk.
• Account Security: You are responsible for all activity that occurs through your account, even if such activity was not committed by you. Please safeguard your login credentials.
• Security Breaches: If you discover any security vulnerabilities or unauthorized access, please notify us immediately and change your password.

We are not liable for any losses resulting from unauthorized modifications to your device or your failure to protect your account security.

7. Internet Connectivity Requirements

Some features of the Service require an active internet connection to function properly, including AI analysis, data synchronization, and report generation.

• Connectivity Requirements: You must ensure you have a stable internet connection. We are not liable for any lack of functionality due to network interruptions, poor signal, or data usage limitations.
• Data Charges: Use of the Service may incur data usage charges from your telecommunications service provider, which you are responsible for paying.
• Offline Features: Some basic features (such as data logging) can be used offline, but advanced features such as AI analysis require an internet connection.

8. Privacy Policy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your personal and health data.

9. User Data Usage License

To improve the AI functionality of the Service and provide a better user experience, when you use the AI analysis features of the Service, you grant us the following limited data usage rights:

• Service Improvement: Some complete AI requests and responses (including pseudonymized health data) are retained for the purpose of optimizing AI prompts and response quality, debugging, and improving service functionality; developers may manually review this content. See Chapter 9 of the Privacy Policy for retention periods.
• Aggregate Statistics: We may use this data to produce overall statistics that cannot identify any individual.
• Data Protection: We remove your email address before transmission.
• No Selling: We will not sell your personal health data to third-party advertisers or marketing companies.
• Cannot Opt Out Individually: Using AI analysis features implies consent to the retention described above. If you do not consent, you may choose not to use AI analysis features, and the basic recording functionality of the App will not be affected.

You retain ownership of your original data. The above license is solely for improving the Service and producing statistics that cannot identify any individual, and does not affect your control over your own data. If you wish to delete your data, please refer to the data deletion process in our Privacy Policy.

10. Third-Party Service Integration

The Service may integrate third-party health data platforms, including but not limited to Apple Health (iOS) and Health Connect (Android). The accuracy, availability, and security of these third-party services are the responsibility of the respective service providers. We make no warranties regarding the accuracy, completeness, or reliability of data provided by third parties. Apple Health Integration (iOS): If you choose to connect mojo with Apple Health, we will read the health data you authorize (such as weight, body fat percentage, exercise, sleep, etc.). The accuracy of this data depends on your Apple device and the data quality of Apple Health. We are not responsible for data provided by Apple Health. Health Connect Integration (Android): If you choose to connect mojo with Health Connect, we will read the health data you authorize (such as weight, body fat percentage, exercise, sleep, etc.). The accuracy of this data depends on your Android device and the data quality of Health Connect. We are not responsible for data provided by Health Connect. When using third-party services, you agree to comply with the terms of service of those third parties. You understand and agree that you use third-party services at your own risk, and we are not liable for any losses resulting from third-party services.

11. Intellectual Property

All content of the Service, including but not limited to: application design, graphical interfaces, text, images, trademarks, code, and AI algorithms, are owned by the developer or its licensors and are protected by copyright law and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes only. You may not:

• Copy, modify, or distribute any part of the Service
• Reverse engineer, decompile, or attempt to extract source code
• Use the Service for commercial purposes or resale

Any commercial use without written authorization is prohibited.

12. Subscription Service

The Service offers both free and paid subscription versions. Accessing paid features requires a subscription. Subscription Fees: Subscription fees will be charged based on your chosen subscription plan and subscription term. Subscription fees are charged in advance at the beginning of the subscription period. Auto-Renewal: Your subscription will automatically renew at the end of each subscription term, and your payment method will be charged for the next subscription term. We may adjust subscription fees, but such changes will only take effect after your current subscription term ends. If you do not agree to the new fees, you may cancel your subscription before the end of your current subscription term. Cancellation and Refunds: You may cancel your subscription at any time through the Apple App Store or Google Play account you used to purchase, but there are no refunds for paid fees. If you cancel before the end of your subscription term, you will continue to have access to paid features for the remainder of the subscription term. If we suspend or terminate your account due to your violation of these Terms, you will not receive any refund. Payment Processing: We use Apple and Google Play as third-party payment processors. Payment processing will be subject to the terms and privacy policies of the payment processor. We are not responsible for errors by the payment processor. Continued Use Reaffirms Authorization: Your continued use or failure to terminate your subscription reaffirms that we are authorized to charge your payment method for the applicable subscription fees.

13. Service Changes and Interruptions

We reserve the right to modify, suspend, or terminate the Service (in whole or in part) at any time without prior notice. We are not liable for any losses resulting from service changes, interruptions, or termination. Terms Updates: We may update these Terms of Service at any time. When the Terms are updated, we will notify you within the application or via email. Updated Terms will take effect immediately upon publication. If you continue to use the Service after the Terms are updated, it will be deemed that you accept the new Terms. If you do not agree to the new Terms, please stop using the Service.

14. Account Termination

Termination Rights: We may terminate or suspend your account and bar access to the Service at any time, without prior notice or liability, for any reason including but not limited to: violation of these Terms, providing false information, abusing the Service, or engaging in illegal activities. Your Termination Rights: You may stop using the Service and delete your account at any time. After account deletion, your personal data will be handled in accordance with our Privacy Policy. Consequences of Termination: Upon account termination, you will lose all access to the Service. We recommend exporting important data before deleting your account.

15. Limitation of Liability

To the maximum extent permitted by law, we and our officers, directors, employees, affiliates, or agents shall not be liable to you for any indirect, incidental, special, punitive, or consequential damages arising out of or in connection with your use or inability to use the Service, including but not limited to:

• Loss of profits, data loss, or business interruption
• Any health damage resulting from health decisions made in reliance on information provided by the Service
• Device damage or data loss
• Errors or failures of third-party services
• Unauthorized access to your account or data

This limitation of liability applies even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of liability for indirect or consequential damages, so the above limitations may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by law.

16. Dispute Resolution and Governing Law

Governing Law: The interpretation and application of these Terms, as well as any disputes arising from these Terms, shall be governed by the laws of the Republic of China (Taiwan), without regard to its conflict of law principles. Jurisdiction: Both parties agree that the Taipei District Court in Taiwan shall have jurisdiction as the court of first instance. Dispute Negotiation: In the event of any dispute, both parties shall first attempt to resolve it through amicable negotiation. If negotiation fails, the dispute shall be submitted to the competent court.

17. No Warranty

The Service is provided on an "as is" and "as available" basis, without any express or implied warranties, including but not limited to:

• Service Availability: We do not guarantee that the Service will be permanently available, uninterrupted, or error-free.
• Data Accuracy: We do not guarantee the accuracy, completeness, or reliability of AI analyses, reports, or recommendations.
• Health Outcomes: We do not guarantee any weight loss results, health improvements, or other expected outcomes. Results vary by individual and depend on multiple factors, including your health condition, diet, exercise, medication use, etc.
• Technical Issues: We are not liable for service interruptions caused by technical failures, network outages, data loss, or other force majeure events.

You understand and agree that you use the Service at your own risk. Any advice or information, whether oral or written, obtained from us or through the Service, will not create any warranty not expressly stated herein.

18. Miscellaneous

Severability: If any provision of these Terms is held to be illegal, invalid, or unenforceable by a court of competent jurisdiction, such provision shall be interpreted and enforced to the maximum extent permitted by law. The remaining portions of these Terms shall remain in full force and effect. Waiver: Our failure to exercise or enforce any right conferred upon us hereunder shall not be deemed to be a waiver of any such right. A waiver of any right hereunder at any given time shall not be deemed a waiver thereof at any other time. Entire Agreement: These Terms (together with our Privacy Policy) constitute the entire agreement between you and us concerning the Service and supersede all prior or contemporaneous oral or written communications, proposals, and representations. No Assignment: You may not assign or transfer these Terms or any of your rights or obligations under these Terms. We may freely assign these Terms. Language: These Terms are provided in Chinese and English. In case of any inconsistency, the Chinese version shall prevail.

19. App Store and Google Play Terms

If you obtained this application through the Apple App Store, it is also subject to Apple's Licensed Application End User License Agreement, available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/ On the matters that agreement governs, it prevails over these Terms in the event of a conflict. If you obtained this application through Google Play, the preceding paragraph does not apply.
